When the IRS Can Levy Your Wages
While some people may think the IRS can levy your wages whenever they wish,
they can only levy wages after the following
three requirements are met:
- They sent you a "Notice and Demand for Payment"
- You did not pay the tax or refused to pay said tax
- They sent you a "Final Notice of Intent to Levy and Notice of Your
Right to A Hearing" at least 30 days before the levy took affect
The intent to levy notice can be given in person, left at your home or
place of business, or sent via mail to your last known address. If the
levy on your bank account or wages is causing you hardship, you must contact
the IRS immediately and explain your situation. The IRS can release the
levy if they agree it is causing you hardship, but you will still be held
accountable for the taxes you owe.
